Terms & Conditions

1. The Youngs Insurance Brokers Make It A Great Day contest start date is 8:00 a.m. EST, June 26, 2006 and the closing date is 4:59:59 p.m. EST December 31, 2007 (the “contest period”). NO PURCHASE NECESSARY.

2. To Enter Personal Contest: To enter and be eligible to win, entrants must visit www.youngsinsurance.ca/en/contestform and complete in full the on-line contest entry form. Limit of one entry per person or per e-mail address throughout the Contest Period. Entrants may obtain additional entries by referring others to the contest. Entrants will receive one (1) additional entry for every valid referral they provide (valid email address). Entries made at community or sporting events sponsored by Youngs whereby entry forms are made available from an authorized representative of Youngs Insurance will be entered into the contest within 48 hours of being completed by the Entrant. Entrants will have until December 31, 2007 at 4:59:59 p.m. Eastern Time ET (the “Closing Date”) to visit the Web site www.youngsinsurance.ca and register for the contest. Entries become the property of Youngs Insurance Brokers Inc. and will not be returned. Youngs Insurance Brokers Inc is not responsible for entries that may be lost, damaged, misdirected, illegible, delayed or not received.

3. To Enter Corporate Contest: To enter and be eligible to win, entrants must visit www.youngsinsurance.ca/en/corporatecontest and complete in full the on-line contest entry form. Limit of one entry per business. Entries made at community or sporting events sponsored by Youngs whereby entry forms are made available from an authorized representative of Youngs Insurance will be entered into the contest within 48 hours of being completed by the Entrant. Entrants will have until December 31, 2007 at 4:59:59 p.m. Eastern Time ET (the “Closing Date”) to visit the Web site www.youngsinsurance.ca and register for the contest. Entries become the property of Youngs Insurance Brokers Inc. and will not be returned. Youngs Insurance Brokers Inc is not responsible for entries that may be lost, damaged, misdirected, illegible, delayed or not received.

4. Prizes:  (1) Personal Contest: Eighteen (18) monthly prizes will be awarded consisting of $250.00 CDN in the form of a cheque or money order payable in the name of the winner.  One (1) Grand Prize will be awarded consisting of $7,500.00 CDN in the form of a cheque or money order payable in the name of the winner. Odds of winning depend on the total number of eligible entries received at the date and time of drawing. (2) Corporate Contest: Six (6) quarterly prizes will be awarded consisting of Coffee for 6 months (includes machine to a maximum of $500). Odds of winning depend on the total number of eligible entries received at the date and time of drawing.

5. Eligibility: The Contest is open to all legal residents Ontario eighteen (18) years of age or older on the day the entry is submitted. Employees of Youngs Insurance Brokers Inc., its affiliated companies and associated resort properties, its representatives or agents, advertising or promotional agencies, prize suppliers/sponsors and members of their immediate families (spouses, children, siblings, and parents) or those living in the same household are not eligible. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, provincial, and local laws and regulations. By participating, entrants agree to abide by and be bound by these Official Contest Rules and to accept the decisions of Youngs Insurance Brokers Inc. as final. The Corporate Contest is open to any business legally registered in Canada and operating in the province of Ontario.

6. Winner Selection: (1) Monthly prize drawings: A random drawing will be conducted by independent judges in Welland, Ontario. On the 15th of each month of the Contest Period at 5:00 p.m. EST the independent judges will randomly draw from all eligible entries received by 4:59:59 p.m. EST on the date of drawing. (2) The Grand Prize random draw will be conducted by independent judges will be held in Welland, Ontario on or about December 31, at 5:00:00 p.m. EST from all eligible entries. (3) Corporate Contest drawings: A random drawing will be conducted by independent judges in Welland, Ontario. At 5:00 p.m. EST the independent judges will randomly draw from all eligible entries received by 4:59:59 p.m. EST on the date of drawing. Corporate draw dates: September 1, 2006; December 1, 2006; March 1, 2007; June 1, 2007; September 1, 2007; December 1, 2007.

7.  Prize Winner Notification: In order to win a Prize, the winner must correctly answer, unaided, a time limited, arithmetical, skill-testing question.  Winner will also be required to sign and return the standard Declaration and Release Form and consent to the use of their name, city and/or photograph, without further compensation, in any marketing or publicity carried out by Youngs Insurance Brokers or their representatives or its advertising, marketing and promotions firm relative to this contest. Winners will be notified by telephone, mail, email or courier. The skill-testing question and the Declaration and Release Form (if any) will be sent via mail, email, fax or courier. The prize will be forfeited if the prize notification is returned as non-deliverable, if the skill-testing question is not correctly answered within the time period specified, or if the Declaration and Release Form(s) is not returned within 21 days from the time the prize notification package was sent. Any taxes, fees or incidental charges applicable to any prize shall be the sole responsibility of the winner of the prize.

8. Additional Terms: By participating, entrants agree to: (a) these Official Contest Rules and the decisions of Youngs Insurance Brokers Inc., which shall be final in all respects; and (b) release, discharge, indemnify and hold harmless Youngs Insurance Brokers Inc, each of its respective subsidiaries, affiliates, officers, directors, and employees, including their promotional agencies, from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

9. Limitation of Liability: Youngs Insurance Brokers Inc. shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, or postage-due requests; or for prize claims that are posted late or incorrectly or are lost due to computer or electronic malfunction. Youngs Insurance Brokers Inc. reserves the right to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest as determined by Youngs Insurance Brokers Inc. in its sole discretion.

10. Liability:  The winners and those accepting the prizes with the winners agree that the prizes are awarded on the condition that Youngs Insurance Brokers Inc. have no liability whatsoever for injuries, losses, or damage of any kind resulting from the participation in the drawing or resulting from the use or acceptance of any prize or participating in any prize-related activities.

11. Limitation of Technical Liability: All entries/prize claims become the property of the Youngs Insurance Brokers Inc., which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the web-site during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by Youngs Insurance Brokers Inc. on account of technical problems or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down-loading any material in the promotion. Youngs Insurance Brokers Inc. reserves the right, in its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of Youngs Insurance Brokers Inc. corrupt the security or proper administration of the contest.  Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Youngs Insurance Brokers Inc. reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Entries and prize claims are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. 

12. Dispute Resolution: Subject to other legal rights and remedies available to you under applicable provincial consumer protection laws, and subject to your consent, you agree that a simplified arbitration proceeding by a sole arbitrator shall be the initial recourse used to resolve any claim or dispute (whether originating in contract or tort, or pursuant to any applicable statutes, regulations or common law principles and whether past, present or future) that arises out of or is related to: (a) these Contest Rules; (b) any oral or written statements; or (c) any promotions or advertisements related to the Contest. You and sponsor will make every reasonable effort to agree on the appointment of the arbitrator within fifteen (15) days of the commencement of the arbitration proceeding, failing which, the arbitrator will be appointed by the court in the province of Ontario. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
